BAHAMAS REWARDS PROGRAM
OFFICIAL RULES

  1. OVERVIEW: The Bahamas Rewards Promotion (the "Rewards Program") offers Bahamas Specialists the opportunity to earn $100 Gift Cards (Rewards) for booking stays at properties in the Islands of the Bahamas. The Rewards Program begins on Dec. 1, 2008 and ends on Oct. 31, 2009 (the "Promotion Period").
  2. ELIGIBILITY: Eligibility is limited to travel agents who (i) are Bahamas Specialists, (ii) are affiliated with a U.S. travel agency operating a current and legitimate ARC/IATA or CLIA designated agency, (iii) graduates of the Bahamas Specialist Program, and (iv) are a U.S. resident, age 18 or over as of December 31, 2007 (Eligible Specialists). Both the Bahamas Specialist Course and enrollment in the Rewards Program are free. For information on becoming a Bahamas Specialist, go to www.travelagentacademy.com/Bahamas.   3. BONUS BOOKING REWARDS: $100 Gift Card from eshopbahamas.com, which are redeemable for merchandise. For details on the Gift Cards including any restrictions and limitation on usage, go to www.eshopbahamas.com.
  4. HOW TO EARN REWARDS: Each Eligible Specialist who earn 10,000 points during the Promotion Period, which are actually used and consumed by guests by Dec. 31, 2009, is eligible to earn a Reward. Three- or four-night hotel/package is 1,000 points; five- or six-night hotel/package is 1,500 points; seven nights or more hotel/package is 2,000 points. Points are cumulative. To receive credit for any reservation, the Eligible Specialist must post the booking on www.BahamasRewards.info. All consumed reservations are subject to verification by Sponsor and/or Administrator whose decision will be final. Bahamas Specialists who change travel agencies during the Promotion Period will need to re-enroll in the Bahamas Rewards Program under the new agency. Such Specialists' reservations under the different agencies will not be aggregated, but will be counted separately for purposes of calculating his/her total reservations. Reservations of different Specialists working in the same or different travel agencies will not be aggregated. Any reservation given to another Specialist will be disqualified.
  5. ISSUANCE OF BONUS BOOKING REWARDS: Gift Cards will be sent by e-mail approximately 2 weeks after the Eligible Specialist redeems 10,000 qualified points. Bahamas Rewards are not transferable. No substitution of Bahamas Rewards is permitted, except by Sponsor, in its sole discretion, for a reward of equal or greater value.
  6. GENERAL CONDITIONS: Sponsor reserves the right to cancel or modify, in whole or in part, the Rewards Program if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Program. In such event, Sponsor reserves the right to award Rewards which have been earned through the termination of the Rewards Program. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Rewards Program or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Rewards Program is a violation of criminal and civil law, and Sponsor reserves the right to seek damages from such person to the fullest extent permitted by law.
  7. RELEASE: By entering this Rewards Program, entrant agrees to release and hold harmless Bahamas Tourist Office, Performance Media Group, Inc., their affiliates, any promotional partners, and each of their respective officers, directors, employees, and agents (collectively the "Released Parties") from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Rewards Program or utilization of any Reward(s) issued.
  8. LIMITATION OF LIABILITY: The Released Parties shall not be responsible for: (1) any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Rewards Program; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the reservation booking process; (4) technical or human error which may occur in the administration of the Rewards Program or the processing of reservations; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Rewards Program, or (6) late, lost, misdirected or incomplete bookings. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy will be to receive credit for another qualified reservation.
  9. DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or in connection with the Rewards Program, or any Reward issued shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of New Jersey or the appropriate State Court located in Morris County, New Jersey; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Rewards Program but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, or to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Rewards Program shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules.
  10. MISCELLANEOUS: Void where prohibited, taxed or restricted by law. All federal, state and local taxes on Rewards are the sole responsibility of the Reward recipients. By entering into this Rewards Program entrants agree to abide by these Official Rules and all decisions of Sponsor which will be binding. Acceptance of a Bonus Booking Reward constitutes permission by a Eligible Specialist to use his/her name, likeness, the name of the travel agency, business address, and statements attributable for him/her for advertising/promotion purposes without additional consideration, except where prohibited by law.
  11. SPONSORSHIP: The sponsor of the Rewards Program is Bahamas Tourist Office (New York), 60 East 42nd Street, Suite 1850, New York, NY 10165 (the "Sponsor"). The Rewards Program is administered and supported by Performance Media Group, Inc., 593 Rancocas Road, Westampton, NJ 08060 (the "Administrator").
